A tale of two Lawyers / Una historia de dos abogados

Regular readers will be wondering whether we managed to pay the gas bill. 

We had received a bill for November-15 December 2010 for an eye watering €25,000 for the central building.  We didn’t have the money. Last year Sol Andalusí SA had agreed that they would pay a 40% contribution towards this from 1^st December 10, and although they never signed we feel that by agreeing to the increased contribution they were acknowledging their duty to pay.

So the community paid only 60% of the December portion of the bill.  Cepsa rang me and said if we didn’t pay the outstanding balance of around €2400 by 5pm on Thursday they would cut us off.  I said that on principle, we would not pay and explained why.  Sol Andalusí’s lawyer called our community lawyer, José Luis Castillo,  who called me and said if we did not pay it then Sol Andalusí’s lawyer will claim against me for damages. 

However, the chapter ended happily. At the last possible moment Sol Andalusí agreed to pay their contribution to the gas bill.  The story continues. On Tuesday 15^thFebruary we have a meeting with Sol Andalusí, with lawyers and Sagesa present, where we hope to find a mutually satisfactory conclusion to the saga of energy charges in the central building. 

Los lectores habituales del blog se preguntarán que ha pasado con la factura del gas.

Recibimos una factura de gas por el mes de Noviembre y primera quincena de Diciembre por la alucinante cantidad de 25.000€ del Edificio Central. No teníamos el dinero. El año pasado Sol Andalusí acordó que contribuiría con un 40% de la factura a partir del 10 de Diciembre, y a pesar de que dicho acuerdo nunca se firmó creemos que al acceder a aumentar su contribución implícitamente reconocían su deber de pagar.

Así que la Comunidad pagaría exclusivamente el 60% de la cantidad del mes de Diciembre. Cepsa me llamó y me notificó que si no se hacían efectivos los 2.400€ que faltaban antes de las 5 de la tarde del jueves nos cortarían el suministro. Les expliqué que, por principios, no podíamos pagar y el porqué. El abogado de Sol Andalusí llamó a nuestro abogado, José Luis Castillo, el cual me llamó para advertirme que si no pagábamos nos iban a demandar por daños y perjuicios.

Al final, todo se resolvió de forma satisfactoria. En el último minuto Sol accedió a pagar su contribución a la factura del gas. La historia continúa. El próximo martes 15 de febrero tenemos una reunión con Sol Andalusí, con la presencia de los respectivos abogados y Sagesa, y donde esperamos alcanzar una solución satisfactoria para ambas partes en la saga de los costes de energía del edificio central.
