Antonio Cifrián Yagüe y Juan Iribarren Guerrero (English below)

Tengo algunas buenas noticias y otras que son realmente malas.

Empezando con las malas, me apena el tener que comunicaros que Antonio Cifrián Yagüe, de 54 años, falleció hace dos semanas. Muchos de ustedes recordarán que junto a su cuñado Juan Iribarren Guerrero (como tesorero), Antonio presidió la Asociación de Propietarios que propició el impulso necesario para fortalecer la Comunidad Fase I.

Antonio Cifrián Yagüe

Nacido en Madrid, Antonio vino a Málaga en 1983, donde inició su carrera como ginecólogo. Más adelante, se especializó en técnicas de reproducción asistida y fertilización y, junto a otros especialistas pioneros en la materia, fundó Málaga FIV.

Paralela a su actividad médica, junto a su mujer Ana y Juan Iribarren fundaron el  vivero Espacios Fuengirola S.L. En 1985 abrieron un laboratorio  de cultivos para propagación vegetal, que fue uno de los primeros de España. Consiguieron una excelente reputación por sus altos niveles de calidad, hasta que en 2010 cerraron la empresa por motivos personales.

Antonio deja mujer, Ana, y tres hijos de 26, 24 y 17 años, así como muchos, muchos amigos.

Nada puede mitigar el dolor de las palabras anteriores, pero estoy encantada de al menos poder proporcionales noticias bastante mejores. A pesar de este trágico suceso, Juan Iribarren ha accedido a presentar su candidatura a Presidente siempre y cuando yo le acompañe como Vice-Presidenta. No se me ocurre nadie mejor para representarnos, por lo que debemos estarle realmente agradecidos y darle todo nuestro apoyo. Su CV habla por sí mismo, además de que habla inglés y tiene experiencia contable.

Juan ha escrito lo siguiente para presentarse:

"Nací en Madrid el 22.02.1957, así que pronto voy a cumplir los 57. Mi formación es de Licenciado en Química por la Complutense de Madrid, y luego un MBA impartido por la misma Complutense y el Instituto Técnico de Enseñanza Empresarial de Málaga.

Llegué a Málaga en 1982 y empecé a trabajar en el vivero Espacios Fuengirola S.L. Esta ha sido mi principal actividad durante los últimos 30

años de mi vida. Nuestro vivero ha sido principalmente un vivero de producción, vendiendo especies en todo el territorio nacional y también dedicado a importación/exportación de especies. También trabajamos en el diseño de paisajes."

Juan posee dos viviendas en el edificio Giralda. 

De acuerdo a la última lista de deudores generada con los documentos de convocatoria, muchos propietarios que generalmente están al corriente de sus obligaciones figuran ahora en mora. No creo que necesitéis que se os recuerde que no podréis votar si no estáis al corriente de pagos, por lo que os urjo a que lo hagáis ahora (no durante la reunión, que retrasa muchísimo la misma). Si ya sabes que no vas a poder acudir, por favor asegúrate de que mandas tu delegación de voto.

I have some very good news and some terrible news.

Antonio Cifrian Yagüe

To start with the bad, I am saddened to tell you that Antonio Cifrian Yagüe, 54, died two weeks ago.  All those owners at Sol Andalusí will remember that Antonio chaired the Association of Owners and alongside his brother-in-law, Juan Iribarren Guerrero as Treasurer, initiated the move to strengthen Fase 1 community.  

Born in Madrid, Antonio came to Malaga in 1983, where he started his gynaecological practice.  Later, he specialised in reproduction and fertilisation techniques and, with other pioneering doctors, founded Malaga FIV.

Besides his medical involvement, Antonio and his wife Ana, were partners with Juan Iribarren in the nursery Espacios Fuengirola S.L.  In 1985 they set up a tissue culture laboratory for plant propagation which was also among the first in Spain.  Having enjoyed a reputation for high standards and quality for more than 20 years, the company ceased trading in 2010 for personal reasons.

Antonio leaves his wife, Ana, and three  children, aged 26,24 and 17. As well as many, many good friends.

Nothing can assuage the previous words, but I am relieved and delighted to be able to bring you some more welcome news.  Despite this calamity, Juan Iribarren has agreed to stand as President on the condition that I stand as Vice-President.  I can think of no-one better to represent us and we should feel very grateful and he should be given our support. His CV speaks for itself, he speaks English, and he has accounting experience. 

By way of introduction, Juan has written a few words:

“I was born in Madrid the 22.02.1957, so I will be pretty soon 57 years old. My academic background is Chemical studies in Universidad Complutense de Madrid, and afterwards an MBA issued by Univ. Complutense de Madrid and Instituto Técnico de Enseñanza Empresarial de Málaga.

I arrived in Malaga in 1982, starting work in the nursery Espacios Fuengirola S.L. This has been my main activity for the last 30 years. Our nursery has been mainly a production company, wholesaling all over Spain and also with export / import activity. Also we operated in the landscaping area”.

Juan owns two apartments in La Giralda.   According to the most recent debtors list which was sent with the AGM documents, many owners who are normally regular payers are shown as in debt.  You don’t need to be reminded that you cannot vote if you are a debtor so please settle up now, (not at the AGM which delays the proceedings).  If you are not going to attend please be sure to submit your proxy vote. 

La Junta General de Fase 1

Ricardo, Pedro Hoz, Alberto, José Luis y yo nos divertimos mucho ayer en los juzgados.

Chechu y Luis Jr nos habían denunciado por desconectar del generador el gimnasio, el restaurante y la cocina cuando el corte de luz por impago en el edificio central en Mayo del año pasado.

Chechu además me acusó de golpearle con una pala de jardín. Que os parece?

Esperaremos sentencia, pero mientras esperábamos a que nos llamara el juez durante más de hora y media nos dio tiempo a organizar la convocatoria de la Junta General de Fase 1.

La Junta será el próximo 15 de Febrero de 2014, sábado, a las 10.00h. Se celebrará como la última vez en el área que hay en la segunda planta del edificio central, en el cuerpo que separa los estudios, donde está el ascensor panorámico.

Todos sabemos lo largas y tediosas que pueden resultar estas reuniones, y más aún con el hecho de que todo ha de ser traducido, así que voy a intentar que tengáis la mayor cantidad de información posible antes de acudir a la reunión.

No me voy a presentar a la re-elección, tres años y medio es más que suficiente. Tampoco lo hará Ian Matthews como vice-presidente, así que por favor id pensando en a quienes os gustaría nominar y/o votar y aseguraos que consiga los votos necesarios. Para ello no necesitáis el modelo oficial de delegación de voto, cualquier documento firmado en el que figuren los datos necesarios para identificar a ambas personas y datos de la reunión sirve. Os haré saber si alguien se presenta.

For those who have never had the pleasure of attending a court in Málaga, this is what the room looks like.

AGM notification

Ricardo, Pedro Hoz, Alberto, José Luis and I had great fun in court yesterday.

We had been denounced by Chechu and Luís Jnr for having disconnected the gym, restaurant and kitchen from our generator back in May 2013 when the central building was left without power because of non payment of the electricity bill.

Chechu also accused me of hitting him with a garden spade.  What do you think?

We await the sentence, but as we spent three hours hanging around before the case was heard, we put the time to good use and set a date for Fase 1 AGM.

The meeting will be at 10.00h, Saturday 15th February 2014.  It will be held as once before on the 2nd floor landing outside the panoramic lift in the centre section of the main building at Sol Andalusí.  

We all know how long and tedious these meetings can be, exacerbated by the fact that everything has to be translated, so I will do my best to provide you with as much information as possible beforehand. 

I will not stand again for President as three and a half years is quite long enough.  Neither will Ian Matthews stand as Vice-President, so do please think about who you would like to nominate or elect and ensure you gather proxy votes in good time.  You do not need the official proxy form, just a signed document with the details of the meeting and the relevant names.  I will let you know if anyone comes forward.

Concurso acreedores / bankcruptcy

Dear all,

On 15th October 13 we attended a meeting at the offices of the administrators.  Ricardo took minutes of the meeting but the administrators asked us to wait before we shared what we had been told.

In that meeting, it was explained to us that Sol Andalusi will go into liquidation in the immediate future and that the administrators will take complete control of Sol Andalusi SA.  They agreed that they had a moral obligation to ensure that none of the residents at Sol Andalusi are left without the services of telephone, internet, electricity and water.  We cannot begin to organise future provision of the services as we do not yet have access to the areas where the controls are located.

I am shocked and disappointed.  We have been unable to make any contact with the administrators and hope that this is because they are occupied with trying to establish how to correct this abysmal situation.

I will inform you as soon as I have some news.

El 15 de octubre 13 asistimos a una reunión en las oficinas de los administradores. Ricardo tomó actas de la reunión, pero los administradores nos pidió que esperar antes de que compartimos lo que nos habían dicho .

En esa reunión , se explicó a nosotros que Sol Andalusi entrará en liquidación en el futuro inmediato y que los administradores tendrá el control total de Sol Andalusí SA . 

Estuvieron de acuerdo en que tenían la obligación moral de asegurar que ninguno de los residentes de Sol Andalusí se quedan sin los servicios de teléfono, Internet , electricidad y agua. No podemos empezar a organizar el futuro de los servicios, ya que aún no tenemos acceso a las zonas donde se encuentran los controles.

Estoy conmocionado y decepcionada.  No hemos sido éxito de hacer cualquier contacto con los administradores y esperamos que esto se debe a que están ocupados en tratar de establecer cómo corregir esta situación abismal.

Vuelvo con noticias lo antes que posible

I am sorry I have been silent for so long. 

•             The community office has sent a letter to the administrators of Sol Andalusi SA asking for information regarding the future of Sol Andalusi SA.  We understand that their report should be published soon, but to date we have received no official confirmation of what is going on.

We do know that the restaurant and bar staff attended a meeting, in which they were told that the bar and restaurant will be closed on 4^th November 13 and will remain closed until at least March, but that there was no guarantee that it would re-open then.

•             The installation of the independent lines and meters to apartments in the Central Building started on time and has been going according to plan.  We were pleased to raise over 50% of the funds in order to commence works and we have almost enough to pay the second instalment, but as predicted we will be significantly under-funded for the third payment. 

There will be more detailed information soon, but in the meantime if you have promised funds that you have not transferred, please do so now so that we can be sure how much the shortfall is.

•        Naturally we are all concerned for residents at Sol Andalusi who do not have independent transport.   Once they had the shuttle bus, and the mini-market on site, but without these and the news there will soon be no bar, this “resort” bears little resemblance to that which was promised.

Jo Winstanley, Karina Pyper and Tracy Ospina are trying to co-ordinate having supplies such as newspapers, bread and milk brought to Sol Andalusi on a regular basis as well as organise a coffee morning for residents, friends and neighbours.  Please let me know if you wish to have contact details.

•             We were recently visited by a consultant who works for the Town Hall, to measure the decibel level of the refrigeration tower.  The community had intended never to open this piece of machinery again, but Sol have been using it to provide cooling to their properties and business.   We now know that it was over the acceptable level, but we must wait for the study to be submitted to the Town Hall. We hope they will insist on its closure as people have been losing sleep and tenants, as the noise is insufferable, especially for those in Giralda and La Mezquita.

•         Once again I have had a few people saying they are looking for apartments to rent on a long-term basis.  If you have a two bedroom apartment available please let me know when it is available and and the rental price

•             You may have heard there was a fire a few weeks ago…it happened when the roadway outside Torre del Oro was being dug up in order to access the water pipe.  This is an edited version of what Ricardo said about it:

There was a massive leak of water in the Torre del Oro building, we don’t know how long has it been leaking as it was going into the sewage system, so nobody could see it.  It was only by coincidence that Chema was cleaning the sewage pipes before the rainy season that he noticed it. The leak was in the Torre del Oro building somewhere in between the garage door and the bungalows, probably in the middle of the road.

They had to dig up the road and damaged the gas pipe which burst. There were flames, I called the fire brigade, sent Chema to close the main gas valve and we ran in to make sure no one was still in the building. There was then a frightening second explosion but luckily it blew the main water pipe so the escaping water dowsed the flames. Chema managed to turn off the gas at the mains and everything was over.

Damages are quite bad; sliding garage door completely burnt, including the engine, access door also burnt, the contents of one of storage rooms are badly burnt, Torre del Oro 2-C flooded (there was this geyser of water coming from ground floor up to second floor straight into this property that kept the flames down, otherwise it would have been a real disaster) plus several minor damages.

Noticias en español 10 octubre 13

Estimados todos:

Primero pediros perdón por no haber estado en contacto desde hace tanto tiempo.

• ·      Desde la oficina de la Comunidad se ha enviado una carta a los administradores concursales pidiendo información relativa al futuro de Sol Andalusí SA. Entendemos que deben estar a punto de publicar la memoria del concurso. Acabamos de recibir respuesta de los administradores pero no tenemos nada que nuevo que comunicarles ya que estamos concertando cita con ellos para una reunión de urgencia.

Sabemos que el personal del bar y restaurante han tuvo una reunión en la que se les informó de que ambos locales se cerrarían a partir del 4 de Noviembre y que permanecerían así cerrados como mínimo hasta Marzo, pero sin garantías de esta hipotética reapertura.

• ·          La instalación de las líneas individuales y contadores de corriente en el edificio central empezó a tiempo y la obra se está desarrollando acorde a los plazos previstos. Hemos conseguido recaudar más del 50% de los fondos para empezar la obra, y tenemos suficiente como para casi cumplir con el segundo pago, pero como preveíamos no vamos a tener para el tercer y cuarto pago.

Habrá más información y más detallada pronto, pero mientras tanto si te has comprometido a pagar y no has transferido los fondos todavía, por favor hazlo ya para que podamos calcular cuánto nos falta todavía.

• ·      Naturalmente estamos preocupados por todos aquellos residentes que no tienen medio de transporte propio. Una vez tuvieron la posibilidad de uso del minibús, y el supermercado en el edificio central, pero sin esto ni con las noticias de cierre del bar y el restaurante, este “resort” dista bastante de lo que se nos prometió que iba a ser.

Jo Winstanley, Karina Pyper y Tracy Ospina están intentando coordinar servicios como el reparto de periódicos, que haya un reparto regular de productos básicos tales como pan y leche así como organizar mañanas de desayunos con los residentes, amigos y vecinos. • Recientemente estuvo un técnico enviado por el Ayto. de Alhaurín de la Torre para medir el nivel de decibelios de la torre de refrigeración. La intención de la Comunidad ha sido siempre la de no volver a abrir la torre nunca más, pero Sol la ha estado usando para suministrar aire acondicionado a sus viviendas y locales. Sabemos que los niveles de ruido estaban muy por encima de lo tolerable, pero debemos esperar a que el informe llegue al ayuntamiento y que éste actúe. Esperamos que el ayuntamiento insista en el cierre de la torre ya que hay gente que ha perdido inquilinos y horas de sueño debido al insufrible nivel de ruido, especialmente en Giralda y Mezquita.

• Una vez más tengo algunas peticiones de alquileres de larga duración. Si dispones de una vivienda de dos dormitorios para alquilar por favor házmelo saber y dime el precio de alquiler.

•  Puede que hayas oído hablar de un fuego en el edifico Torre del Oro hace unas semanas … ocurrió cuando se estaba levantando la calle que da acceso al garaje del bloque porque se iba a reparar una fuga de agua. Esta es la versión de lo que pasó descrita Ricardo:

Hubo una gran fuga de agua en la acometida general del edificio Torre del Oro. No sabemos por cuanto tiempo estuvo la fuga, ya que la rotura estaba justo al lado de un desagüe de pluviales que recogía toda el agua vertida, así que nadie se dio cuenta. Fue por casualidad que Chema, empleado de mantenimiento, estaba limpiando las arquetas anticipando la temporada de lluvia que se percató de la fuga. La fuga estaba en algún punto entre los bungalows y la entrada del garaje del Torre del Oro, probablemente debajo de la calzada.

Tuvieron que excavar en la carretera con una máquina, con la mala suerte de romper una tubería de gas, que al contacto con la llama de la caldera hizo explosión. Hubo un incendio, por lo que llamé a los bomberos, envié a Chema a cerrar la espita general del gas y entré en el edificio a ver si había alguien. Huno entonces una segunda explosión que por suerte reventó otra tubería de agua que hizo que limitara el daño del gas ardiendo. Para entonces Chema consiguió cerrar el gas y estuvo todo bajo control.

Los daños son bastantes; la puerta del garaje está completamente quemada, incluyendo el motor, hay un trastero quemado con su contenido, la vivienda Torre del Oro 2-C tiene la terraza inundada (se produjo un geiser de agua desde la calle hasta la terraza de la vivienda que impidió que las llamas crecieran, de otra forma pudo haber sido un auténtico desastre) y múltiples daños menores.

El corte / The disconnection

Of course the board very much regret what happened at Sol Andalusí, in particular in the central building and I am so sorry for the huge upset the disconnection meant for everyone living in the central building.  The community was always ready to pay its share of the electricity bills but Sol Andalusi did not arrange to make a payment, and legally they don’t have to, as they are protected by conditions of the voluntary bankcruptcy.

Por supuesto el Comité lamenta profundamente lo que ocurrió la semana pasada en Sol Andalusí, en el edificio central en particular, y de verdad que siento el daño causado a todos los que viven en el edificio central. La comunidad siempre estuvo dispuesta a pagar su parte de las facturas de la luz, pero Sol Andalusí no hizo lo necesario para preparar el pago, y aparentemente no tienen por qué hacerlo al estar bajo el amparo del concurso de acreedores.

·      We did know that there was a threat from Iberdrola that we could be cut off but I really could not believe that we, the community was expected to pay when neither Sol Andalusi nor its administrators were prepared to pay a Euro, and neither had a Euro of community fees been paid

·      Sabíamos que había un aviso de corte de Iberdrola pero realmente no podíamos creer que nosotros, la comunidad, tuviéramos que afrontar el pago sin que ni Sol Andalusí ni los administradores concursales tuvieran que hacerlo.

·      The Community Fase 1 should not pay for Sol Andalusi’s consumption of electricity but that is what was being expected of us.  Despite the administrators efforts to persuade a Judge to make a ruling, Iberdrola decided to disconnect us anyway.

·      La Comunidad de Sol Andalusí Fase 1 no debería pagar por los consumos de electricidad efectuados por la empresa Sol Andalusí, pero eso es lo que esperaban. A pesar de los esfuerzos de los administradores concursales para persuadir al juez de que ordenara a Iberdrola que no nos cortara, éstos hicieron caso omiso.

·      Eventually an agreement was reached and the community paid, €13.713 and the administrators paid €9142.  I am told it was unusual for this to happen so quickly, although of course it felt anything but swift to all those living in the main building.

·      Se llegó a un acuerdo en el que la Comunidad pagó  13.713€ y los administradores concursales más de 9.142€. Me dijeron que no es habitual que el reenganche se produzca tan rápido, a pesar que para la gente que vive en el edificio central pareciera de todo menos rápido.

(You might also be interested to know, that someone modified the feed to the generator so that the gym would be supplied)

(También os interesará saber que alguien modificó las líneas a las que alimenta el generador para que servicios como el gimnasio pudieran tener electricidad).  

Now Iberdrola are threatening to disconnect again if a payment is not made. Today I have authorised a payment of 50% of the debt,  ie,  €15.463,93 to avoid disconnection and although the administrators agree to pay the other 50% I am told that Chechu is not sure they have the money!  Apart from the debt there are other costs of some €7000 that have been incurred as a direct result of the disconnection.   I have no idea whether Sol will pay their share.

Ahora Iberdrola nos está volviendo a amenazar con un nuevo corte si no se hace efectivo otro pago. Hoy he autorizado el pago del 50% del importe pendiente, 15.463,93€, para evitar dicho corte, y a pesar de que los administradores han dado su aprobación al pago del restante 50%, se me ha comunicado que Chechu no está seguro de que disponga de semejante cantidad! Además de la citada deuda, hay otro coste asociado al corte de unos 7.000€ que también están pendientes de pago. Tampoco tengo la menor idea de si Sol piensa pagar su parte de este coste.

You will be wondering what is happening about the installation of individual meters and accounts to each property in the central building.   The project was carried out using the extra payments of €161,85€ that was agreed in the EGM of  November 14.

It was very dispiriting to learn that the cost of this installation is €295.000 plus IVA.  The cost would be borne mostly by owners in the central building but also with a contriubtion from the aterrazados towards the purifying plant, swimming pool and water pumps, decalcifyer  etc.

I have asked Tallante, the installers, to reduce theprice and they have also agreed to a payment plan.  I know this is a huge amount of money but it is the only way as it would give us complete independence, once and for all, from Sol Andalusi or any other commercial enterprise that might take up the businesses in the future.   If such a unsatisfactory and inadequate installation had not been made in the first place we would not be in this predicament now.

Os estaréis preguntando que se está haciendo de cara a independizar las líneas de electricidad en el edificio central. El proyecto se elaboró pagándolo mediante una derrama de 161,85€, aprobada en la Junta Extraordinaria del 14 de Noviembre de 2012.

Fue descorazonador el comprobar que el coste de la obra a efectuar para lograr la independización de las líneas es de, en el mejor de los casos, 295.000€ más IVA. El coste es para los propietarios de viviendas en el edificio central, aunque los demás propietarios deben hacer una pequeña contribución para las líneas de la depuradora, piscina, aljibe y descalcificadora.

He pedido a Tallante, la empresa instaladora, que ajuste el presupuesto al máximo y también han acordado darnos facilidades de pago. Sé que es una cantidad ingente de dinero, pero es la única forma de conseguir la completa independencia, de una vez por todas, de Sol Andalusí o de cualquier otra empresa comercial que pudiera quedarse con el negocio en un futuro. Si esto se hubiera hecho desde el principio por parte de la promotora no nos veríamos en esta complicadísima situación ahora.

Finally, some slightly better news.  Thanks to efforts from Ian Matthews and Alberto at Sagesa,  the amount owed to us by debtors has been reduced by about 5% (not including that owed to us by the Martinez family and friends and Sol Andalusi SA).

Finalmente, algunas noticias algo más alentadoras. Gracias a los esfuerzos de Ian Matthews y Alberto de Sagesa, la cantidad que tenemos en morosidad se ha reducido en un 5% (excluyendo las cantidades adeudadas por la familia Martínez, allegados y Sol Andalusí SA).
